Who are
the insureds?
- The Professional Order;
- All members in good
standing of the Professional Order who participate in the professional liability program;
- Former members in good
standing of the Professional Order for losses resulting from professional services
rendered while they were members in good standing and participated in the Order's
professional liability insurance program;
- Any nurse benefiting
from a special authorization issued by the Order;
- Any person authorized
to exercise professional activities by virtue of a regulation adopted by the Bureau
of the Order under section 94 h) of the Professional Code and approved by the government;
- Any specialized nurse
practitioner candidate during the period in which he or she is eligible to sit the
specialty examination;
- Any student duly matriculated
and registered in a program leading to the obtaining of a diploma granting entitlement
to a permit from the Order;
- Any of the aforementioned
persons' legal heirs or assigns;
- The company owned by
one or more insured members in good standing:
- when proceedings
are brought with regard to the professional activities of this or these members;
- when proceedings
are brought with regard to the professional activities of company employees who
are members in good standing and have enrolled in the professional liability plan
of the named insured.

Your professional liability:
- Namely
for the payment of compensatory damages that you may be required to
pay to third-parties as a result of a claim received by you and filed
with La Capitale during the period extending from April 1, 2010 until March 31, 2011 and arising from fault, negligence, or a lack of care
or skill in the performance of your insured professional activities;
- Additionally, we shall
notably assume your expenses for defence in such litigation involving professional
liability.
Your expenses for defence
before a criminal jurisdiction:
- Namely the reimbursement
of your expenses for defence and professional fees in any action taken against you
before a court of criminal jurisdiction following the exercising of professional activities,
except if you plead guilty or are declared guilty by judgment having the binding force
of he matter adjudged.
Your expenses for defence
involving illegal practice :
- Namely the reimbursement
of expenses for defence and professional fees that you may incur in any action taken
against you for the illegal practice of another profession, except if you plead guilty
or are declared guilty by judgment having the binding force of the matter adjudged.
Your expenses for legal
assistance before the coroner :
- Namely the reimbursement
of your legal expenses for assistance involving any appearance as an interested party
before a coroner's enquiry or an enquiry or similar special commission within the
framework of or during the exercising of your professional activities, excluding however
cases in which you are called upon to act as expert witness on such occasions.
What
activities are insured?
All professional services
rendered or that should have been rendered, directly or indirectly, by the insured in
connection with the nursing profession as well as alternative practices recognized by
the Order. These services include, among others, teaching, research, supervision, monitoring,
opinions and counselling, as well as services rendered in a training program.
Insured activities are
those performed in Canada as well as activities that are additionally or occasionally
performed outside the country which may lead to legal action taken against you in Canada.

In the
case of loss
Your main obligations
- You must refrain from
admitting any liability and/or engaging in any expense or negotiation of your own
initiative;
- You must necessarily
report to your insurer any fact or circumstance that may give rise to a claim as soon
as you become aware of such matters;
- You must provide your
insurer with support and cooperation in the conducting of any enquiry and possible
legal proceedings;
